Your information will remain confidential and will not be disclosed to anyone unless you grant permission, except in cases where it is legally mandated. As a component of the service, Self Clarity Guide gathers the phone numbers of potential members who receive information through text messages. Rest assured that these phone numbers will never be distributed.

4. After successfully completing the registration process for the Service, you will be provided with an account designation and a password. It is your duty to keep your account and password confidential, and you bear full responsibility for any actions carried out using your account or password. You agree to (a) promptly inform Self Clarity Guide if you discover any unauthorized use of your account or password or any other security breach, and (b) ensure that you log out of your account after each session. By subscribing to Self Clarity Guide or using its services, you agree to protect, compensate, and absolve Self Clarity Guide, along with its officers, agents, and employees, from any claims, complaints, demands, or lawsuits, including reasonable attorney’s fees, brought by any party due to or arising from your subscription with Self Clarity Guide or your use of its services.

7. The service provided by Self Clarity Guide is non-transferable. You are prohibited from reproducing, duplicating, copying, selling, trading, reselling, or exploiting any part of the service, its usage, or access to the service for any commercial purposes.

8. Self Clarity Guide reserves the right to temporarily or permanently modify or terminate the service (or any part of it) at any time and without prior notice.

9. By using the Service, you acknowledge and agree that Self Clarity Guide reserves the right to promptly terminate your Self Clarity Guide account and access to the Service in certain circumstances, without prior notice. The termination may occur for various reasons, including but not limited to: (a) violations of the TOS or other incorporated agreements or guidelines, (b) requests from law enforcement or government agencies, (c) your voluntary request to delete your account, (d) discontinuation or significant changes to the Service or its components, (e) unforeseen technical or security issues, and/or (f) your involvement in fraudulent or illegal activities. In the event of termination, your Self Clarity Guide account will be deleted, including your password and all associated information, and you will be prohibited from further use of the Service. Additionally, you understand and agree that Self Clarity Guide holds sole discretion in terminating your account for cause, and it will not be held responsible or liable for any loss of access to the Service or termination of your account.

10. By using the Service, you recognize and consent to the fact that both the Service and any essential software utilized in relation to the Service (“Software”) comprise confidential and proprietary information safeguarded by relevant intellectual property and other laws. Unless explicitly permitted by Self Clarity Guide, you commit to refraining from altering, renting, leasing, loaning, selling, distributing, or generating derivative works from the Service or the Software, either wholly or partially.

11. By using the Service, you explicitly acknowledge and agree that you assume full responsibility and risk. The Service is provided on an “as is” and “as available” basis. Self Clarity Guide explicitly disclaims all warranties, whether expressed or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Self Clarity Guide does not guarantee that (i) the Service will be uninterrupted, timely, secure, or error-free, (ii) the results obtained from using the Service will be accurate or reliable, or (iii) any errors in the Software will be corrected. Any advice or information obtained from Self Clarity Guide or through the Service, whether oral or written, does not create any warranty not expressly stated in the Terms of Service. Please be aware that a small portion of users may experience epileptic seizures when exposed to certain light patterns or backgrounds on a computer screen or while using the Service. Certain conditions may trigger epileptic symptoms that were previously undetected, even in users without a history of seizures or epilepsy. If you or any member of your family has an epileptic condition, it is recommended to consult a physician before using the Service. If you experience any of the following symptoms while using the Service—dizziness, changes in vision, eye or muscle twitches, loss of awareness, disorientation, involuntary movement, or convulsions—please discontinue using the Service immediately and consult your physician.

12. You explicitly acknowledge and agree that Self Clarity Guide holds no liability towards you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, loss of goodwill, use, data, or other intangible losses (even if Self Clarity Guide has been informed of the possibility of such damages). These damages may arise from: (i) your use or inability to use the Service; (ii) the expenses incurred in obtaining substitute goods and services resulting from the purchase, acquisition, or receipt of goods, data, information, or services through or from the Service; or (iii) any other matter related to the Service.

13. In certain jurisdictions, it may not be permissible to exclude specific warranties or limit or exclude liability for incidental or consequential damages. Consequently, some of the aforementioned sections’ limitations may not be applicable to you.

14. Self Clarity Guide has the ability to notify you, such as regarding changes to the Terms of Service, through various means including email, traditional mail, or announcements on the Service.

15. The trademarks and service marks affiliated with Self Clarity Guide, including the Self Clarity Guide logo, along with other logos, product names, and service names associated with Self Clarity Guide, are recognized as Self Clarity Guide Marks. Self Clarity Guide grants you authorization to utilize Self Clarity Guide marks for advertising brochures, sign riders, and other marketing initiatives.

16. Entire Agreement: The Terms of Service (TOS) constitute the entire agreement between You and Self Clarity Guide, governing your utilization of the Service. It overrides any prior agreements between You and Self Clarity Guide pertaining to the Service.

Choice of Law and Forum: The TOS and the relationship between you and Self Clarity Guide will be subject to the laws of the State of Arizona, without regard to any conflicts of law provisions. Both parties consent to the personal and exclusive jurisdiction of the courts situated within the State of Arizona.

Waiver and Severability of Terms: The failure of Self Clarity Guide to exercise or enforce any right or provision stated in the TOS does not relinquish that right or provision. If any provision of the TOS is deemed invalid by a court with competent jurisdiction, the parties still agree that the court should make efforts to uphold the parties’ intentions reflected in the provision. The remaining provisions of the TOS remain fully valid and effective.

No Right of Survivorship and Non-Transferability: Your Self Clarity Guide account cannot be transferred, and any rights to your account or its contents will cease upon your death. Upon submission of a death certificate, your account may be terminated, and all its contents permanently deleted.

Statute of Limitations: Regardless of any contrary statute or law, any claim or cause of action arising from the use of the Service or the TOS must be filed within one (1) year after the claim or cause of action arises, or it will be permanently barred.
